Its a slippery slope. Its in danger of just becoming easier for landowners just to "Say No" Again....personal opinion

Its just one more tool that we have at our disposal in assuring private property owners that they are not on the hook for everything that could possibly go wrong when it comes to agreeing to allow trail-builders to create paths across their property.

I love building on Crown and Parkland (with appropriate permissions) but there comes a time when we have to deal with private property owners, and not all of them are as easy / pleasant to deal with as the Sather family... :-)

Right now for instance, a friend is about to request permission for us to build a new section of trail from the Garnet Fire Interpretive Center on down to Sailken Dr. in 2014 The very end of the trail will pass through private property for 60 meters.

Said friend will be able to show this land owner that - should someone crash and burn on the trail, the land owner is not going be sued and stand to loose everything just because he allowed trail users to pass through a small piece of his land.

The Occupiers Liability Act is a tool - one that I feel we should use under the right circumstances. The 2014 Carmi project is case-in-point.
